1. CONCEPTS
1.1. Administrator – KOBIOKI marketing department employee.
1.2. Personal data means any information relating to a natural person, i.e. a data subject, who is identified or can be identified, directly or indirectly, by reference to data such as e-mail address, one or more physical, physiological, psychological, economic, cultural or social features specific to that person.
1.3. Personal data controller – KOBIOKI, UAB “Biokobi international”,Lazdijų g. 18B, Kaunas, LT-46349, Republic of Lithuania.
1.4. Account means a KOBIOKI login account, which is created by active actions of the Buyer according to the specified sequence of actions on the KOBIOKI website and where the Buyer’s personal data and order history are stored.
1.5. Services – all services provided by KOBIOKI to the Customer, including, but not limited to, the sale of goods on KOBIOKI.
1.6. A customer is: (i) a competent adult; (ii) legal persons.
1.7. Password – is a combination of letters and/or numbers created and used by the Customer to register in the KOBIOKI system and in their Account.
1.8. A cookie is a small text file that is sent to and temporarily stored on the device of each person visiting KOBIOKI from which they access KOBIOKI.
1.9. The Rules are the rules for the purchase and sale of goods on KOBIOKI.
1.10. Direct marketing means the activity of offering goods or services to persons by post, telephone or other direct means and/or seeking their opinion on the goods or services offered.
1.11. KOBIOKI is a b2b platform located at www.b2b.kobioki.com, managed by UAB Biokobi international, a company established and operating in accordance with the legislation of the Republic of Lithuania, with the code – 304285464, address for correspondence – Lazdijų g. 18B, Kaunas, Lithuania, the data about the company shall be stored and collected in the Register of Legal Entities of the Republic of Lithuania, Kaunas branch.
1.12. KOBIOKI Partner means a person who supplies goods or services to KOBIOKI; with whom joint promotions or projects may be carried out.
1.13. KOBIOKI Accounts are KOBIOKI accounts on various social networks (e.g. Facebook), where KOBIOKI actively communicates with its existing and/or potential customers.
1.14. Messenger is a customer communication and marketing tool.
 
2. GENERAL PROVISIONS OF B2B.KOBIOKI.COM PRIVACY POLICY

2.1. Persons wishing to purchase goods and/or services and/or create an account on KOBIOKI must provide the following data: name, surname, telephone number, e-mail address, and address of the place of residence and/or place of delivery. The Buyer shall be held responsible for the accuracy of the data provided.
2.2. By placing an order, the Buyer agrees to the processing of the personal data provided by him/her for the purpose of fulfilling the order. The Buyer also agrees that the email address provided by the Buyer shall not be used by the Buyer. the postal address to send information messages necessary to complete the order.
2.3 The Buyer’s personal data may be processed for marketing purposes only if the Buyer himself/herself expresses his/her consent by filling in the registration form.
2.4. The Buyer may at any time modify and/or complete his/her Personal Data by logging in to the created Account on KOBIOKI and by contacting KOBIOKI by e-mail. email info@kobioki.com for assistance in changing your details and to cancel your Account.
2.5. If the Customer, after purchasing goods and/or services from KOBIOKI, does not wish the Personal Data provided to be used for Direct Marketing purposes or wishes to remove the User. The Buyer must log in to his/her Account on KOBIOKI and click on the statement “Delete Account” in the “My User” section of the Account under “User Information”. Alternatively, in all cases, the Buyer may send an e-mail to info@kobioki.com and indicate that he/she does not wish to receive e-mails and/or SMS messages. The sending of e-mails and/or SMS messages shall only be interrupted if the Buyer expressly mentions the following e-mails. postal addresses and/or telephone numbers. The customer can also unsubscribe from the newsletter by clicking on the “unsubscribe” or “unsubscribe” link at the bottom of the newsletter.
2.6. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except when required by a competent State authority in cases provided for by the laws of the Republic of Lithuania or by the Buyer’s separate written consent.
2.7. KOBIOKI confirms that the Personal Data provided by the Customer will be processed only for the purpose of providing the Customer with the services provided by KOBIOKI (including the right to participate in promotions, projects). KOBIOKI also confirms that the Personal Data provided by the Buyer will be processed for the purposes of KOBIOKI business analysis and Direct Marketing, provided that the Buyer gives and does not withdraw such consent.
2.8. KOBIOKI undertakes not to disclose the Buyer’s Personal Data to third parties, except with the Buyer’s consent, when fulfilling an order through KOBIOKI partners and in accordance with the procedure established by the legislation of the Republic of Lithuania.
2.9. The Customer shall have the right: (i) upon written request to KOBIOKI, to have access to his/her Personal Data held by KOBIOKI
(ii) make a request to KOBIOKI in writing, by email to info@kobioki.com, for an Account, to request the use of his/her Personal Data, and to obtain information on the sources and purposes for which the Personal Data is processed, and to which recipients the Personal Data is provided and has been provided for at least the last one (1) year.
deletion or suspension of Personal Data management actions when this is done in violation of the provisions of the legislation, except in the cases provided for in the Privacy Policy; (iii) disagree with the Privacy Policy and the disposition of the Buyer’s Personal Data in accordance with the procedure set out in this Privacy Policy, in which case the Buyer will not be able to purchase goods and/or services in the electronic store KOBIOKI; (iv) perform other actions as provided for in the Privacy Policy and the law.
2.10. 2.9 p. in the relevant cases listed above, KOBIOKI shall provide the Buyer with the following no later than within 30 (thirty) days
reply and carry out or refuse to carry out the action requested in the request.
2.11. The Buyer’s identity document requested at the time of collection and the Buyer’s data contained therein shall only be used to identify the Buyer’s identity.
2.12. By accepting this Privacy Policy, the Customer agrees that his/her Personal Data may be used to fulfil his/her order, regardless of whether he/she orders goods and/or services from KOBIOKI as a seller or from Partners, and also agrees that his/her Personal Data may be passed on to KOBIOKI Partners.
2.13. The Buyer’s Personal Data shall be provided to the Member States of the European Union or other foreign countries under the same terms and conditions and in the same manner as to entities located in the Republic of Lithuania and only for the purposes set out in this Privacy Policy.
2.14. KOBIOKI stores Personal Data for as long as the person uses KOBIOKI services, except for the cases specified in this Privacy Policy.
2.15. After cancellation of the Account, the Personal Data of the Customer may be stored on the Personal Data Controller’s server for a period of up to six months, unless the data provided by the Customer was (i) used in the commission of an unlawful act or (ii) suspected identity theft or other irregularities that have been or will be the subject of an investigation by the relevant law enforcement authorities, (iii) if KOBIOKI has received complaints in relation to the relevant Buyer, or if KOBIOKI has observed violations of the KOBIOKI Purchase and Sale Rules by the relevant Buyer; or (iv) for other legitimate purposes, to retain Personal Data. These data shall be destroyed on lawful instructions from law enforcement or other authorised authorities.
2.16. KOBIOKI internal technological solutions ensure that the Personal Data provided by the Customer to KOBIOKI is protected against any unauthorised actions, loss, unauthorised use and alteration, i.e., the level of protection of personal data complies with the requirements of the legislation of the Republic of Lithuania.
2.17. The Buyer undertakes and must protect his/her KOBIOKI Login Password and Login Name and other data. The Buyer undertakes and is obliged not to disclose to any other third parties any Personal Data about himself or herself or third parties, if such Personal Data of third parties has become available to him or her, and to inform KOBIOKI immediately of any apparent breach.
2.18. The Administrator may use the IP addresses of the Customers in the event of, or in the course of, diagnosing possible malfunctions on KOBIOKI.
2.19. If KOBIOKI doubts the correctness of the Personal Data provided by the Customer, it may suspend the processing of the Personal Data of these Customers, check and clarify the data. Such Personal Data shall only be used to verify its accuracy.
2.20. In order for the Buyer to be able to use the services of the KOBIOKI B2B platfrom to the full extent, Cookies may be placed on the Buyer’s device used to connect to KOBIOKI.
2.21. By accepting the Privacy Policy, the Customer agrees to the placement of the Cookies provided for in this Privacy Policy on his/her device. The Buyer may revoke this consent at any time by changing the settings of his/her web browser, but in this case certain functions of the KOBIOKI online store may not be available.
2.22. Cookies used by KOBIOKI are used for the transmission of information over an electronic communications network. You may delete or block all or part of these Cookies in your browser settings, but in this case some of the functions of the KOBIOKI website may not work. Another type of cookie is used to collect information to calculate traffic (collect statistical information), to provide content that is relevant to the interests of Customers, and to store their visit history. KOBIOKI does not use this type of Cookies, however, the Buyer is advised that some KOBIOKI Partners may use this type of Cookies, and if the Buyer suspects that this type of Cookies is being used without his/her consent, he/she should contact the specific KOBIOKI Partner.
2.23. The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time. Registered Buyers will be notified of any changes, corrections or additions at the time of logging in to KOBIOKI and will be required to re-confirm the Terms and Conditions.
2.24. You can unsubscribe from your Messenger subscription at any time by entering the keyword “Stop” inside the app or “Unsubscribe” in the bottom menu. You will be asked to cancel your subscription.
2.25. KOBIOKI controls subscribers’ data through third party software. If you unsubscribe, you will be completely unsubscribed from all communications. Your data will be automatically deleted after unsubscribing.
 
3. PROCESSING OF PERSONAL DATA
3.1. The Company processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the “Regulation”), the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts regulating personal data processing.
3.2. The scope of the personal data processed depends on the Company’s products ordered, purchased or used and the information provided by the person as a visitor to the Company’s website when ordering, purchasing and/or using the Company’s services, visiting or registering on the Company’s website.
 
4. SOURCES OF PERSONAL DATA
4.1. The Customer shall provide personal data by contacting the Company, registering for services, using the Company’s services, purchasing goods, participating in a loyalty programme, lotteries or competitions, leaving comments, asking questions.
4.2. Personal data is obtained when the Customer visits the Company’s website at KOBIOKI The Company uses cookies on the website. Cookies are files that store information on the Client’s computer hard drive or in a search engine. In this way, the Company may establish that the Customer has visited the Company’s website before. The Company uses cookies to ensure that the Customer has the best experience on the website.
 
5. CLIENT’S LIABILITY

5.1. Inform the Company of any changes to the information and data provided. It is important for the Company to have correct and valid Customer information;
5.2. Provide the necessary information to enable the Company to identify the Client at the Client’s request and to verify that it is communicating or cooperating with a specific Client (either by providing proof of identity or by means of statutory procedures or electronic communications that allow for proper identification of the Client). This is necessary to protect the data of the Client and other persons, so that the information disclosed about the Client is only provided to the Client, without prejudice to the rights of other persons.6. FINAL PROVISIONS

6.1. This Privacy Policy is an integral part of the goods sold by the Company. As the Company develops and improves its business, the Company has the right to unilaterally change this Privacy Policy at any time.

 
7. CHANGING THE PRIVACY POLICY
7.1. The Company has the right to unilaterally change the Privacy Policy in part or in full by notifying the website KOBIOKI.
7.2. If the Client does not agree with the new version of the Privacy Policy, he/she has the right to refuse it in writing by e-mail. by email to info@kobioki.com or by post to Lazdijų g. 18B, Kaunas, Lithuania, LT-46349, with the condition that the Client loses the right to use the services and privileges of the KOBIOKI website as a logged-in user.
7.3.Amendments or changes to the Privacy Policy shall come into effect from the date of their publication, i.e. from the day they are posted on the KOBIOKI website system.
